This Terms of Service Agreement ("Agreement") is entered into by and between Arh24.com ("we," "us," or "our") and you ("Client," "you," or "your"). This Agreement governs your use of all web hosting products and services (collectively, the "Services") purchased from us. By accessing or using our Services, you agree to be bound by the terms and conditions set forth in this Agreement, along with our Privacy Policy, Acceptable Use Policy (AUP), and Service Level Agreement (SLA), which are incorporated herein by reference.
1. Account Eligibility and Responsibilities
1.1. Eligibility: By registering for our Services, you represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into binding contracts. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that entity to this Agreement.
1.2. Account Information: You agree to provide accurate, current, and complete information when creating your account and to keep this information updated. We may suspend or terminate your account if any information provided is found to be inaccurate, fraudulent, or incomplete.
1.3. Account Security: You are solely responsible for maintaining the confidentiality and security of your account credentials (including passwords and login links). You are also responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.
2. Services, Content, and Resource Usage
2.1. Services: We agree to provide the Services described on the specific plan you have purchased, subject to the terms of this Agreement. We reserve the right to modify, amend, or discontinue any Service at our discretion, with reasonable notice provided to you when possible.
2.2. Your Content: You are solely responsible for all content, data, and materials ("Content") that you upload, store, or transmit through our Services. You warrant that you own or have the necessary rights to your Content and that its use does not violate our AUP or any third-party rights.
2.3. Resource Usage (Shared Hosting): Our shared hosting plans (including Web Hosting and WordPress Hosting) are designed for the needs of typical small to medium-sized websites. While some resources may be described as "unmetered," all accounts are subject to a fair use policy. Excessive use of server resources (CPU, RAM, disk I/O, or network bandwidth) that negatively impacts the performance or stability of the server for other clients is prohibited. We reserve the right to suspend or require an upgrade for accounts consistently exceeding reasonable usage limits.
2.4. Prohibited Uses: Your use of the Services must comply with our Acceptable Use Policy (AUP) at all times. Prohibited activities include, but are not limited to, spamming, hosting illegal or malicious content, and any activity that disrupts our network or violates the law.
3. Payments, Renewals, and Refund Policy
3.1. Fees and Payment: You agree to pay all fees for the Services you purchase, in accordance with the pricing and payment terms presented to you at the time of purchase. All payments are due on the first day of the billing cycle (e.g., monthly, annually).
3.2. Automatic Renewal: To ensure uninterrupted service, all hosting plans and most domain names will automatically renew at the end of the billing period. You will be charged the then-current renewal fee using the payment method on file. You are responsible for ensuring your payment information is up to date.
3.3. Cancellations: You may cancel your Services at any time through your client area portal. Cancellations must be submitted before the start of your next billing cycle to avoid future charges. No refunds will be issued for partial-month usage.
3.4. 30-Day Money-Back Guarantee & Refund Policy:
We offer a 30-day money-back guarantee on new purchases of our Shared Web Hosting and WordPress Hosting plans. If you are not satisfied within the first 30 days, you may request a full refund of the hosting fee.
The following products, services, and fees are strictly non-refundable:
- Domain Name Registrations, Renewals, and Transfers.
- VPS Hosting, Windows RDP VPS, and Dedicated Servers.
- Software licenses (e.g., cPanel, Plesk, Windows Server).
- SSL Certificates (unless part of a free offering).
- Service Add-ons, Setup Fees, and Migration Fees (if applicable).
- Renewals of any hosting service after the initial 30-day period.
Accounts terminated for violating this Agreement or our AUP are not eligible for any refund. To request a refund, please contact our billing department through the client portal.
4. Backup and Data Loss
Your use of the Services is at your sole risk. While we may perform periodic courtesy backups for our own disaster recovery purposes, **you are solely responsible for creating and maintaining your own backups of your Content.** We do not guarantee the existence, accuracy, or completeness of any courtesy backups. We strongly recommend you use our provided backup tools or a third-party service to keep regular backups of your data. Arh24.com is not liable for any data loss, regardless of the cause.
5. Website Migration Service
Arh24.com may offer a complimentary or paid website migration service. This service is provided on a best-effort basis. You are responsible for providing accurate access credentials to your old host and for verifying the integrity of your website after migration. You must maintain a separate backup of your data before, during, and after the migration process. By using this service, you agree that Arh24.com is not liable for any data loss or issues that may arise. Full terms for this service are available upon request and are incorporated herein by reference.
6. Term and Termination
This Agreement will remain in effect as long as you use our Services. We may suspend or terminate your account and Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of this Agreement or our AUP. Upon termination, your right to use the Services will cease, and we may permanently delete your Content from our servers.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Arh24.com, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US FOR THE AFFECTED SERVICES DURING THE THREE (3) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH CLAIM.
8. Indemnification
You agree to defend, indemnify, and hold harmless Arh24.com and its employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of this Agreement.
9. Governing Law and Dispute Resolution
This Agreement shall be governed and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions. Any dispute arising from this Agreement shall be resolved through binding arbitration in Multan, Pakistan, in accordance with the rules of a recognized national arbitration body.
10. Changes to this Agreement
We reserve the right to modify these Terms at any time. We will provide you with notice of material changes by posting the new terms on our site and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
